U.S. TSCA Form

The Toxic Substances Control Act (TSCA) is administered by the U.S. Environmental Protection Agency (EPA). This document is required for most chemical goods, water samples and products that fall under the jurisdiction of the EPA and are being imported into the U.S. The TSCA form is a declaration that the substances being shipped either comply with the TSCA or are not subject to the TSCA.

The Toxic Substances Control Act is intended to ensure that the human health and environmental effects of chemical substances are identified and properly controlled prior to placing these materials into commerce. The U.S. Toxic Substances Control Act (TSCA) Form is required when shipping certain chemical products to the U.S. regardless of value. The TSCA document or a statement on the Commercial Invoice is required for chemical goods and products that fall under the jurisdiction of U.S. Environmental Protection Agency (EPA). The exporter or importer is required to submit a completed certification with each import of a product that falls under the TSCA of the EPA. Example of goods that require the TSCA are: water (imported as samples for testing), oil (crude and processed), plastic in raw forms (beads), chemicals in powder or liquid form, soaps, detergents, waxes, earth (clay in various forms), and stone (raw states). Chemical substances/mixtures/products such as additives in food and drug products, regulated by other government agencies, may fall under negative certification. The Toxic Substances Control Act (TSCA) of 1976 was enacted by Congress to give EPA the ability to track the 75,000 industrial chemicals currently produced or imported into the United States. EPA repeatedly screens these chemicals and can require reporting or testing of those that may pose an environmental or human-health hazard. EPA can ban the manufacture and import of those chemicals that pose an unreasonable risk. This form must be completed to confirm that all chemicals or chemical substances being shipped comply with the Toxic Substances Control Agency (TSCA).
